James Martingano's practice encompasses a range of complex litigation matters, with an emphasis on in products, defending toxic tort claims, specifically the defense of alleged exposure to a variety of industrial products and chemicals including benzene, butadiene, vinyl chloride, silica, asbestos, lead, and manganese (welding rods). After receiving his degree from Texas Tech University School of Law in 1994, he joined MehaffyWeber in the firm's Houston office and become a shareholder in 2000.
Representative Experience
James regularly defends corporations throughout the State of Texas, including major energy and petro-chemical companies such as E. I. du Pont de Nemours and Company ("DuPont"), Exxon Mobil, Kellogg Brown & Root, Hess Corporation, Valspar, Shell, and Unocal. He has successfully tried both personal injury and property loss claims to verdict in the State of Texas.
While his major areas of practice are toxic torts and premises liability claims, he has experience in a broad array of other litigation matters and has handled a number of other types of cases, including product liability cases involving wrongful death and catastrophic personal injury claims stemming from industrial accidents and natural gas explosions. He has also represented clients in environmental nuisance claims, as well as mass tort litigation including breast implant and pharmaceutical litigation.

James Martingano has been a speaker at several education seminars including: American Conference Institute Chemical Products Litigation, "Common Issues Defense Strategy" (Chicago, IL April 27, 2010) and HarrisMartin Benzene Litigation Conference, "Trial of a Solvent-Lymphoma Case from Jury Selection to Verdict"(Manhattan, NY, December, 2008).

Education
James graduated from Texas A&M University in 1990 with a B.S. in Sociology. He received his J.D. in 1994 from Texas Tech University School of Law. While in law school, James was a member of the Board of Barristers.

James is a member of the State Bar of Texas, the American Bar Association, the Texas Association of Defense Counsel, the Defense Research Institute, the College of the State Bar of Texas, Houston Bar Association, and the Jefferson County Bar Association.
James has been recognized as a "Texas Rising Star," 2005 - 2007, 2008, and selected as a "Texas Super Lawyer®" in 2008 to 2009 in Texas Monthly magazine.
